These Terms of Use, together with the Privacy Policy below, govern access to and use of for-get.club (the "Platform"). By registering or using the service, you accept everything described here.

Terms of Use

1. What for-get.club is

for-get.club is a one-time-listen audio messaging platform. A registered user (the "sender") records a message and addresses it to another person (the "recipient") by email. The recipient only receives a notification by email — never the audio file or a direct playback link — and must log in to the Platform to access the message. The audio is permanently and irreversibly deleted immediately after playback, or after 7 calendar days if it goes unheard.

2. Registration

Using the service requires an account with a name and a verified email address. Information provided must be accurate. for-get.club may suspend or cancel accounts registered with false information or a third party's identity without their consent.

3. Prohibited use

By using the Platform, you agree not to:

• Record, capture, screenshot, photograph, film, or otherwise reproduce by any technical means — external device, screen or audio capture software, or otherwise — the content of a message you receive.
• Play a message in the presence of anyone other than the intended recipient, on speaker, in a group, or in any way that lets someone other than the recipient access its content.
• Share, redistribute, publish, or otherwise disclose the content of a received message by any means.
• Send content that constitutes a threat, harassment, extortion, defamation, incitement to hatred, non-consensual sexual content, or any other conduct that may be a criminal or civil offense under applicable law.
• Impersonate another person when registering or sending a message.
• Attempt to bypass, circumvent, or manipulate the one-time-listen mechanism, automatic expiration, or deletion of messages.

4. Consequences of violations

Violating the above may result, without prior notice, in immediate suspension or cancellation of the offending account with no refund, retention of internal account records for as long as legally required, referral to the relevant authorities where conduct may constitute a criminal offense, and an express reservation of any civil or criminal action available to the Platform or affected users.

Even when a message is sent or received anonymously as far as the recipient is concerned, for-get.club internally retains the identity of both the sender and the recipient of every message. Anonymity toward the recipient does not mean anonymity toward the Platform or toward authorities in the event of a violation.

5. Intellectual property

The artworks used as background imagery on the Platform belong to their respective owners and are displayed with their consent, with visible credit. Reproduction or use outside the Platform without the rights holder's express authorization is prohibited.

6. Liability

The Platform is provided "as is," in an early pilot phase, without a guarantee of continuous availability. for-get.club is not responsible for the content of messages sent by users, which is the sole responsibility of the sender.

7. Governing law

These Terms are governed by Spanish law. Any dispute will be submitted to the Courts of Barcelona, with express waiver of any other jurisdiction that might otherwise apply.

Privacy Policy

In accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on Data Protection and Digital Rights Guarantee (LOPDGDD), we inform you of the following:

• Registration data: name and email address.
• User-generated content: audio recordings sent through the Platform.
• Message metadata: sender, recipient, send date, status (pending, listened, expired), and listen date.
• Technical data necessary for the service to function.

3. Purpose

• Providing the service: sending, delivering, and playing one-time-listen audio messages.
• Managing the account and credit balance.
• Fraud prevention, incident investigation, and legal compliance.
• Service-related communications, such as notifying you of a pending message.

4. Legal basis

Processing is based on the performance of the service agreement accepted upon registration (GDPR art. 6.1.b), and on the Platform's legitimate interest in preventing fraud and abuse (GDPR art. 6.1.f).

5. Retention period

• Audio is permanently deleted immediately after the recipient plays it.
• If unheard, audio is automatically deleted after 7 calendar days from sending.
• Message metadata is retained while the account stays active and, after closure, for as long as legally required.
• Account data is retained while the user's registration remains active.

6. Who we share data with

To provide the service, for-get.club uses the following data processors (GDPR art. 28): Supabase (database, authentication, and storage, with infrastructure in the European Union), Resend (transactional email delivery), and Netlify (web hosting). Any transfer outside the European Economic Area is carried out under the safeguards of GDPR Chapter V.

7. Your rights

You may exercise your rights of access, rectification, erasure, objection, restriction of processing, and portability at any time by writing to hello@for-get.club. You have the right to lodge a complaint with the Spanish Data Protection Agency (www.aepd.es) if you believe your data is not being processed in accordance with the law.

8. Minors

The Platform is intended for users 18 years of age or older. If we become aware that a minor has registered, their account and data will be deleted.

9. Security

for-get.club applies appropriate technical and organizational measures to protect data: authentication-restricted access, encryption in transit (HTTPS), and effective, irreversible deletion of audio content within the timeframes described in this policy.
